Description of the
Compulsory schooling must, in principle, be completed at the local primary and lower secondary schools (district schools). At the request of the parents or guardians, primary schools or independent lower secondary schools (which are not part of a lower secondary school network) may, for compelling personal reasons, grant permission for a child to attend a different primary or lower secondary school in a different catchment area.
In addition to the guest school placement discussed here, which is based on compelling personal grounds, a guest school placement may also arise through allocation by the State Education Authority in accordance with Article 43(2) of the Bavarian Act on Education and Schooling (BayEUG).
Where there are several secondary schools within a catchment area (secondary school cluster), no ‘guest pupil’ status can arise within the cluster due to the shared catchment area; such status can only arise if a pupil wishes to attend a secondary school outside the cluster, in a different catchment area. Within the group, parents or guardians and pupils of full age have the right to choose a school. This freedom of choice may be restricted by provisions of the association agreement or by the school authority, or where the number of applications exceeds the number of places available at a school, or where the Government deems it necessary in the interests of a balanced composition of classes; however, these restrictions do not apply where there are compelling personal reasons for attending a different school within the network.
The decision is taken by the local authority in which the pupils have their habitual residence, in consultation with the host school authority and after consulting the schools concerned. Once authorisation to attend the host school has been granted, the entitlement to transport ceases. These costs must then be borne by the parents or guardians.
Prerequisites
Visiting pupil arrangements may be approved by the relevant decision-makers in accordance with the conditions set out in Article 43 of the Bavarian Education Act (BayEUG). The decision-makers have discretion regarding the duration for which a visiting pupil arrangement is granted. From an educational perspective, a guest school placement should be granted for at least one school year.
Deadlines
Once the agreed period of exemption from the school catchment area has expired, it may be necessary to reapply for a place at a school outside the catchment area.

Procedure
The completed application form can be submitted either to the relevant local school, the host school or to the local authority. Once a decision has been made on the application to attend a host school, the applicant will receive a notification regarding the host school.
