Description of the
If a building exhibits defects or shortcomings in its internal or external condition which can be rectified or remedied through modernisation or repair, the local authority may order the removal of the defects by means of a modernisation order and the rectification of the faults by means of a repair order.
The owner of the building is obliged to remedy the problems and rectify the defects. The notice ordering the modernisation or repair must specify the defects to be rectified or the shortcomings to be remedied and set a reasonable deadline for carrying out the necessary measures.
In particular, substandard conditions exist where the building does not meet the general requirements for healthy living and working conditions.
Defects shall be deemed to exist, in particular, where they result from wear and tear, ageing, weathering or the actions of third parties
- the intended use of the building is impaired to a more than insignificant extent,
- the building complex, by virtue of its external appearance, adversely affects the streetscape or townscape to a more than negligible extent, or
- the building complex is in need of renovation and should be preserved because of its urban planning significance, particularly its historical or artistic importance.
