    Street naming

    The right to name public roads (and squares) is a matter for local authorities to decide. This right to name also includes the right to change existing names. The naming of streets requires a resolution by the local council or a decision-making committee, unless it involves the replacement of nameplates on already named streets that have become illegible. The naming of streets is at the discretion of the local authority. The local authority enjoys considerable freedom in choosing a street name; however, the general limits of that discretion must be observed. The chosen street name must not be offensive or contravene criminal law or the democratic constitutional order. When renaming a street, the existing interests of local residents in retaining the previous street name must be taken into account as part of the balancing of interests. Street naming can be used to honour deserving citizens and to uphold local traditions.

    Street name signs

    Within the scope of its powers regarding the development of land, the federal legislature has laid down provisions in Section 126 of the Building Code concerning identification marks and information signs for development facilities and for (house) numbers. The owner must tolerate the affixing, alteration and removal of identification marks and information signs for development facilities (street name signs, including explanations of the name and details of the properties situated on the street) on their property; however, they are not obliged to install them. Access to the property for this purpose must also be permitted. The costs of installing street name signs cannot be passed on to the owners of the adjacent properties.

    House numbering

    Property owners are obliged to display the house number assigned by the local authority on their property. This obligation includes procuring, fitting, maintaining and bearing the cost of the number plate. In the event of a renumbering, the owner must also bear the cost of the new number plate. The numbering requirement applies to both developed and undeveloped plots of land. Local authorities regulate house numbering through by-laws, which may also specify the design of the number plates and where they are to be affixed.
