Description of the
Socially subsidised rental housing is subject to occupancy restrictions. This creates an obligation for the person authorised to dispose of the subsidised rented accommodation to allocate it only to people who meet certain requirements.
In special cases, there may be sufficient grounds for releasing the tied housing (a single flat or a number of flats) from all ties and instead creating equivalent ties to other housing of the person authorised to dispose of the property. To this end, an application for release from the occupancy commitments must be submitted. In contrast to an exemption, the release from the ties is permanent.
Prerequisites
The competent authority may release the authorised person from the occupancy obligations if
- this serves to create or maintain socially stable resident structures or is necessary for other overriding public interests and
- the person entitled to dispose of other residential property grants commitments of the same overall value for the period after the release from the commitments.
