Description of the
The Free State of Bavaria provides funding for the construction and modernisation of rental flats for people seeking accommodation who are eligible for social housing support. The selection of new building projects to receive funding is based on the urgency of local housing needs. In return for the funding, the subsidised flats are subject to housing restrictions, which may limit both the authorised users (owners) and tenants in their use of the properties. The most significant restrictions here are, above all, occupancy restrictions and rent controls.
The district offices, independent cities, major district towns or “major delegated municipalities” are the authorities responsible for enforcing housing restrictions. Within their respective areas, they ensure that subsidised housing is used for its intended purpose (including subsidised owner-occupied housing that is to be let out during the commitment period). This includes ensuring that the property is occupied by eligible tenants, that the permitted rent level is adhered to, and, for example, matters relating to the expiry of the commitment period and the conversion of social housing into owner-occupied flats. They investigate breaches of housing commitment regulations and, where necessary, evict tenants from the property.
