  • Description of the

    Under Section 33a of the Trade Regulation Act (GewO), you require a licence if you wish to organise commercial performances by individuals on your business premises or make your business premises available for such performances to be held. This does not apply to performances that are predominantly artistic, sporting, acrobatic or of a similar nature.

    In particular, the organisation of striptease and table dance performances is subject to the licensing requirement set out in Section 33a of the Trade Regulation Act (GewO). The licence is usually subject to extensive conditions designed to ensure public safety and order and to uphold public decency.

    This licence is independent of any other catering licence that may otherwise be required.

  • Prerequisites

    • You must possess the integrity required to run a business.
    • The displays must not be contrary to public decency.
    • The commercial enterprise must not, in terms of its location or the use of the premises, be contrary to the public interest; for example, if this gives rise to concerns about harmful environmental impacts within the meaning of the Federal Immission Control Act, or otherwise causes significant disadvantages, hazards or nuisances to the general public.
  • Deadlines

    Permission must be granted before operations commence; it is therefore necessary to submit the application in good time.

    Certificate of good conduct

    Extract from the Central Trade Register

    Where applicable, lease agreement / tenancy agreement or proof of ownership of the premises

    Where applicable, floor plans and site plans, Planning permission

    Documents confirming the employment of staff at registered companies or civil-law partnerships

    For registered companies: an extract from the commercial register or equivalent registration documents from abroad (with a German translation): - for civil-law partnerships: the partnership agreement




    in the case of authorisation: a written power of attorney and proof of identity for both the principal and the authorised representative
    ; for EU citizens: a certificate of good conduct from their country of origin

    a certified copy and a certified German translation; where applicable, these may be replaced by an affidavit or similar formalities




    For non-EU nationals: a residence permit allowing
    them to carry out self-employed work For non-EU nationals: proof of good character

    An official certificate of good conduct or character, or an extract from the criminal record of the applicant’s home country, or an equivalent document, and/or a certificate of good conduct for official purposes and a report from the Central Trade Register

    If, on the basis of the applicant’s previous residence, it can be assumed that the certificates and supporting documents referred to do not contain any facts relevant under commercial law, the requirement to submit the foreign or German certificates may be waived.
